This is a translation of our published German terms. For a Clarity Letter, the offer and checkout also explain the price, payment steps, preparation and delivery time.

1. Scope

These general terms and conditions apply to all counselling, coaching and workshop services offered by Elisabeth Rieder (the “Counsellor”). By booking a service, clients accept these terms and conditions in full.

2. Booking and cancellation

Appointments can be booked online, by email or by telephone.

Individual and couples counselling

You can cancel free of charge up to 48 hours before the agreed appointment. For later cancellations or failure to attend, the full fee will be charged.

Workshops

You can cancel free of charge up to 48 hours before the start. Separate rules apply to POLY Speed Dating and POLY Mingle Vienna: the cancellation fee is 100% from the time the ticket is purchased.

Clients remain entitled to demonstrate that the actual loss was lower.

3. Prices and payment

Current prices for all services are available on the website. Prices include statutory VAT.

Current prices, subject to change:

• Individual counselling, 50 minutes: €165 incl. 20% VAT.
• Couples or group counselling, 100 minutes: €330 incl. 20% VAT.

Payment is due immediately after the session and can be made in cash or by card. Statutory default interest under section 1000 of the Austrian General Civil Code (ABGB) applies to late payments.

Clients will be notified of price changes in advance. Changes apply only to new bookings made after the announcement.

4. Right of withdrawal for distance contracts

When services are booked at a distance, for example through an online booking form, by email or by telephone, consumers generally have a right to withdraw within 14 days of entering into the contract under section 11 of the Austrian Distance and Off-Premises Contracts Act (FAGG).

If clients wish the service to begin before that period has expired, an express declaration in the booking form is required. The right of withdrawal expires when the agreed service has been fully provided.

5. Duty of confidentiality

The Counsellor is subject to the statutory duty of confidentiality under section 119 of the Austrian Trade Regulation Act (GewO). This duty has no time limit and continues after the counselling relationship ends.

The duty of confidentiality ceases to apply where clients expressly release the Counsellor from it.

6. Data protection

Personal data processed in the course of counselling is handled in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG 2018). Information about the data processed, its purposes and your rights is available in the privacy notice.

7. Gesundheitshunderter (SVS)

Clients eligible for the Gesundheitshunderter health subsidy from the Austrian Social Insurance Institution for the Self-Employed (SVS) may use it for eligible services. Information about the requirements is available directly from SVS.

8. Liability

Elisabeth Rieder is liable for loss or damage only in cases of intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law.

This limitation does not apply to personal injury; the statutory provisions apply without restriction in such cases.

Life and social counselling is not psychotherapy and does not replace medical treatment or psychotherapeutic care. Where there are indications of mental illness, clients are referred to appropriate professionals.

9. Illness and force majeure

If illness, an accident or other unforeseeable circumstances (force majeure) prevent the Counsellor from attending an agreed appointment, clients will be notified as soon as possible. The appointment will be cancelled free of charge and rescheduled on request. Further claims, including claims for compensation, are excluded in these circumstances.

10. Crisis protocol and emergencies

Where there is an immediate threat to life or physical safety, particularly a specific risk of suicide or an immediate risk of harm to oneself or others, the Counsellor may depart from the duty of confidentiality in section 5 on the basis of her ethical duty of care and to protect life. Where necessary, this includes contacting the ambulance service (emergency number 144 in Austria) or the police (133 in Austria).

Where there is reasonable suspicion of child abuse or neglect, the Austrian Federal Child and Youth Welfare Act (B-KJHG) provides for a duty to report to the responsible child and youth welfare authority.

By accepting these terms, clients are informed of this possibility.

11. Out-of-court dispute resolution

Elisabeth Rieder is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration body (section 19(3) of the Austrian Alternative Dispute Resolution Act, AStG).

12. Applicable law and jurisdiction

Austrian law applies. The place of jurisdiction is Vienna.

13. Severability

If any provision of these terms is or becomes wholly or partly invalid or unenforceable, the remaining provisions remain effective. Invalid provisions are replaced by the applicable statutory provisions.
